PART V - MAINTENANCE OF WIFE, CHILDREN AND OTHERS

Section 48. Power of the Court to order maintenance of wife and effect of nusyuz.

(1) Subject to the provisions of Hukum Syarak the Court may order a man to pay maintenance to his wife or former wife-

(a) during the subsistence of a marriage;

(b) during the course of a matrimonial proceedings;

(c) for the period of edah when approving or; making or after approving the pronouncement of a talak or after making an order of divorce;

(d) if after an order declaring the wife to be presumed dead, she is found to be alive.

(2) Subject to the provisions of Hukum Syarak and the approval of the Court, a wife shall not be entitled to maintenance if she is nusyuz:

Provided that as soon as the wife repents and agrees to follow the wishes and orders of the husband, she shall no longer be regarded as nusyuz.
