Section 12. Betrothal.

(1) If any party has entered into a contract of betrothal whether in writing or orally, and whether entered personally or through an agent, and refuses subsequently to marry the other party without any cause despite the fact the other party is agreeable to perform the marriage, the party in default shall-

(a) reimburse all the expenses incurred in the preparation of the marriage if such default has caused a loss to the other party; and

(b) shall return all the gifts of the betrothal if any, or the value thereof.
