PART III - REGISTRATION OF MARRIAGES



Section 28. Appointment of Chief Registrar, Registrars, and Assistant Registrars of Muslim Marriages, Divorces and Ruju'.

(1) His Royal Highness he Sultan may appoint any qualified public officer to be the Chief Registrar of Muslim Marriages, Divorces, and Ruju' for the purposes of this Enactment, who shall have general supervision and control over Registrars and the registration of marriages, divorces, and ruju' under this Enactment.

(2) His royal Highness the Sultan may appoint so many qualified persons as may be necessary, to be Registrars of Muslim Marriages, Divorces, and Ruju' for such district in the State of Pahang as may be specified in the appointment.

(3) His Royal Highness the Sultan may appoint so many qualified persons as may be necessary, to be Assistant Registrars of Muslim Marriages, Divorces, and Ruju' for such area in the State of Pahang as may be specified in the appointment.

(4) Every wali Hakim shall by virtue of his appointment be an Assistant Registrar of Muslim Marriages, Divorces, and Ruju' for his area.

(5) His Royal Highness the Sultan may, by notification in the Gazette, appoint any Muslim member of the diplomatic staff of Malaysia in any country to be the Registrar of Muslim Marriages, Divorces, and Ruju' for the purposes of this Enactment in that country.

(6) Every person appointed under subsections (2), and (3) who is not a public servant shall be deemed to be a public servant for the purposes of the Penal Code [F.M.S. Cap. 45.].
