PART III- SYAR'IAH COURTS Procedure in Criminal Proceedings
Section 102. Complaint.
(1) An information with a view to prosecution shall be made in writing or orally to the Qadi of a Syar'iah Subordinate Court.
(2) If made orally, the information shall be reduced to writing by the Qadi himself.
(3) In either event, the Qadi shall require the informant to affirm to the truth of the information.
(4) The informant and the Qadi shall sign the information.
(5) Any Qadi who, after recelvrng the information, finds that the matter of the complaint occurred outside his jurisdiction or falls within the jurisdiction of the Syar'iah High Court, shall forward the complaint to the appropriate Court.
(6) The Court may refuse to take any action on the information if not satisfied that there are reasons to believe that an offence has been committed.
