Section 76. Order determining the mother or father not fit to have hadhanah of child.

(1) A Court may when allowing a divorce or at any time after the divorce on the application of a mother or father of the child of that marriage or on the application of any person having an interest make an order determining the father or mother or a person entitled to the hadhanah of the child as unfit and may at any time revoke such order.

(2) The order made under sub-section (1) shall remain effective even though a person who is more entitled to have hadhanah of the child by virtue of his affinity is dead unless the Court orders otherwise.
