PART VI - MAINTENANCE OF WIFE AND CHILDREN
Section 61. Power of Court to order maintenance for children.
(1) The Court may at any time order a male person to maintain his children-
(a) if he has refused or neglected to provide a reason able sum for their maintenance;
(b) if he has deserted his wife and his children are in the custody of his wife;
(c) while waiting for a decision on a proceeding between a husband and wife; or
(d) at the time of making the order or after the order is made, placing the children in the custody of someone else.
(2) The Court is also empowered to order a person liable under Hukum Syarak to payor contribute towards the maintenance of a child if it is satisfied upon considering his ability to pay it is reasonable to do so.
(3) An order under sub-section (1) or (2) may direct the payment be made to the person who is looking after and managing the children or to the trustee of the children.
