Warrant of Arrest



Section 36. Procedure on arrest of person against whom warrant is issued.

(1) When a warrant of arrest is executed outside the local limits of the jurisdiction of the Court by which it was issued the person arrested shall, unless security is taken under section 32, be brought before the nearest Syariah Judge.

(2) Such Syariah Judge shall, if the person arrested appears to be the person intended by the Court which issued the warrant, direct his removal in custody to the Court named in the warrant:

Provided that if the offence is bailable and the person arrested it ready and willing to give bail to the satisfaction of the Court before which he is brought or a direction has been indorsed under section 32 on the warrant and such person is ready and willing to give the security required by such direction, such Judge shall take such bond or
security, as the case may be, and forward the bond to the Court named in the warrant.

(3) Nothing in this section shall be deemed to prevent a Religious Enforcement Officer or police
officer from taking security under section 32.
