Section 13. No unnecessary restraint and mode of searching a person.

(1) The person arrested shall not be subjected to more restraint than is necessary to prevent his escape.

(2) Whenever it is necessary to cause a person to be searched the search shall be made by a person of the same sex with strict regard to decency.
