(1) Any party desiring to contest the facts deposed to in an affidavit may serve on the party who filed the same, notice of intention to crossexamine the deponent, and thereupon, if the deponent is not produced for cross-examination, the Court shall, except in special circumstances, reject or disregard the affidavit.
(2) The Court may in its discretion requires the presence of any person who affirmed the affidavit and if he fails to appear, the Court may reject or disregard the affidavit.
