ENACTMENT NO. 7 OF 1993 ADMINISTRATION OF ISLAMIC RELIGIOUS AFFAIRS ENACTMENT OF THE STATE OF PENANG 1993
PART III - MUFTI AND SYARIAH COMMITTEE
Section 39. The Syariah Committee
(1) There shall be a Committee to be known as the Syariah Committee.
(2) The Committee shall consist of -
(a) the Mufti, as Chairman;
(b) two officers from the Islamic Religious Department of the State of Penang who are expert in Islamic Law, appointed by the Majlis;
(c) two members of the Majlis nominated by the Majlis; and
(d) at least two but not more than five persons who are expert in Islamic Law to be appointed by the Majlis.
(3) An officer of the Islamic Religious Department of the State of Penang shall be appointed by the Majlis, as the Secretary.
(4) The persons who, immediately before the coming into force of this section, were appointed members of the Legal Committee established under section 35 (1) of the Administration of Muslim Law Enactment 1959 (En 3/1959)shall, to this Enactment, be deemed to have been nominated or appointed to be members of the Syariah Committee and shall continue to be members until the expiry of their current period of appointment.
(5) Whenever the Mufti proposes to make a fatwahe shall call a meeting of the Syariah Committee for the purpose of discussing the proposed fatwa.
(6) Before the Mufti makes a fatwa, he may cause such studies or research to be conducted as he may direct and a working paper prepared.
