ADMINISTRATION OF ISLAMIC RELIGIOUS AFFAIRS ENACTMENT OF THE STATE OF PENANG 1993

PART IX - FINANCIAL MATTERS

Section 90. Establishment of Baitulmal

(1) There shall be established a Baitulmal of the Majlis Agama Islam Negeri Pulau Pinang.

(2) Unless otherwise stated in any provision in this Enactment the Baitulmal shall consist of all moneys and properties, movable or immovable, which by Islamic Law or under the provisions of this Enactment or rules made thereunder; accrue, or which are contributed by any person, to the Baitulmal.

(3) All zakat and ficrah collected under this Part shall be paid into the Baitulmal and shall be kept in separate account in the Baitulmal.

(4) All moneys and properties in the Baitulmal shall be vested in the Majlis which shall administer all such moneys, and properties in accordance with rules made under this Enactment:

Provided that any investments of assets and funds invested in the Majlis may be sold, realised and disposed of, and the proceeds thereof may be invested from time to time in any investments aothorized by any written law for the time being in force for the investment of trust funds.

(5) Subject to the provisions of this Enactment, the Majlis with the approval of the Yang di - Pertuan Agong, may make rules for the collection, administration and distribution of all moneys and properties of the Baitulmal.
