PART VII - BAITULMAL

Section 72. Establishment of Baitulmal.

(1) A fund to be known as Baitulmal shall be established. Such fund shall consist of all money and property, movable or immovable which according to Hukum Syara' or under the provision of this Enactment or rules made thereunder accrue or is contributed or payable by any person to Baitulmal.

(2) Baitulmal shall maintain separate accounts as follows -

(a) Zakat and Fitrah ;

(b) Wakaf and nazar am;

(d) other trust.

(3) All money and property of Baitulmal shall be vested in the Majlis who shall administer them according to the rules made under this Enactment:

provided that any investment of assets ( fund or property) vested in the Majlis may be sold, realised or disposed of, and the proceeds thereof may be invested from time in any investment authorised by any written law for the time being in force for investment of trust funds.

(4) Subject to the provisions of this Enactment, the Majlis may with the approval of Duli Yang Maha Mulia Sultan make rules for the collection, administration, distribution and disposal of all Baitulmal money or property.
