(1) Subject to subsection (2), the Court may on its own motion or on application of any parties at any stage of the proceedings strike out, substitute or add any party in such manner and on such terms as may be just and proper.
(2) No person shall be made a plaintiff without his consent, or if under disability, without the consent of his representative or lawful guardian.
