PART VI - MAINTENANCE OF WIFE AND CHILDREN
Section 59. Recovary of arrears of maintenance.
(1)Any arrears of maintenance unsecured but payable by virtue of an agreement or an order of Court may be claimed as a debt from the party in default of the payment of their maintenance.
(2) If the arrears is accumulated, the aggregate sum has to be settled before a receiving order is made by the Court against the party in default and the arrears may be proved in the proceedings for his bankruptcy.
(3) If the arrears is accumulated and remains unpaid before his death this arrears shall be a debt payable out of his estate.
(4) Arrears of unsecured maintenance and accumulated but payable to the person entitled in his lifetime may be claimed as a debt by his legal representative.
