PART VIII - GENERAL
Section 121. Condition's for lawful acknowledgment.
Where a man acknowledges another person, directly or presumptively, as his child, the man shall be deemed to be the father of the other person in the circumstances following-
(a) no other person is presumed to be the father of the child;
(b) the difference in age between the person acknowledging and the child makes it reasonable for the relationship of the father and child;
(c) if the child is akil baligh and can make a choice, the child agrees to be acknowledged as a child;
(d) the man and the mother of the child could have validly married at the time the child was procreated;
(e) the acknowledgment is not only that the child is his, but that the child is his legitimate child by nasab;
(f) the acknowledger is competent to make an acknowledgment agreement;
(g) the acknowledgment is made solely for the purpose of proving relationship by nasab;
(h) the acknowledgment is clearly made and the child is acknowledged as the child born to him.
