ADMINISTRATION OF ISLAMIC RELIGIOUS AFFAIRS ENACTMENT 1986

PART I - PRELIMINARY



Section 2. Interpretation.

In this Enactment, unless the context otherwise requires -

"appointed date" means the date appointed under section 1 for the coming into force of this Enactment;

"baligh" means the age of puberty in accordance with Hukum Syara';

"Chief Qadi" means the Chief Qadi appointed under section 28, and includes the Deputy Chief Qadi;

"Commissioner" means the Commissioner of Religious Affairs appointed under section 4, and includes the Deputy Commissioner;

"Court" or "Syar'iah Court" means the Syar'iah Appeal Court, the Syar'iah High Court, or a Syar'iah Subordinate Court, as the case may be;

"Department" means the Department of Religious Affairs, Terengganu;

"Fatwa Commitee" means the Fatwa Committee mentioned in section 24;

"Fitrah" means the amount of rice or any other staple food prescribed by the Majlis from time to time, or its value, payable according to Hukum Syara' anually by a Muslim and to be used according as permitted by Hukum Syara';

"the four Mazhabs" means the Mazhab Shafi'i, Hanafi, Maliki and Hanbali;

"Fund" means the Fund of the Majlis mentioned in section 138(1);

"Majlis" means the Majlis Agama Islam dan Adat Melayu established under section 5;

"maukuf" means a weight of which 20 mithqals are equivalent to 2.125 tahil or 85 grammes;

"mosque" means a building, by whatever name called, erected or used for the purpose of congregational prayers and the performance of other amal ibadat relating to the Religion of Islam, and includes a surau or balaisah;

"Mufti" means a Muslim who has reached puberty in accordance with Hukum Syara' and is not mentally defective nor deaf and blind;

"mukim masjid" means the area, whose boundaries are determined under section 173, within which a mosque is situated and which shall not necessarily coincide with the area of any mukim under the National Land Code [56/65];

"nazar" means a verbally-expressed vow creating an obligation upon a person to do any beneficial act for any purpose allowed by Hukum Syara';

"nazar am" means a verbally-expressed vow creating an obligation upon a person to do any beneficial act for the benefit of Muslims generally or any group of Muslims, as distinct from an individual;

"pegawai masjid" means the Chief Imam, Imams, Khatibs, and Bilals of a mosque;

"Penghulu" means a Penghulu who is in possession of a Tauliah from His Royal Highness the Sultan authorizing him to perform duties relating to the interests of the inhabitants of his mukim, and includes an Assistant Penghulu having the like authority;

"President" means the President of the Majlis;

"Qadi" means a Qadi appointed under section 28, and includes the Chief Qadi;

"Resident" means permanently or ordinarily living in aparticular area;

"Secretary" means the Secretary to the Department appointed under section 4;

"State" means any State in Malaysia, and includes the Federal Territory;

"Syar'iah Enforcement Officer' means a Syar'iah Enforcement Officer appointed under section 104;

"Tauliah" means a letter of autority issued by or on behalf of His Royal Highness the Sultan;

"Wakaf am" means a dedication in perpetuity of the capital and income of property for religious or charitable purposes recognized by Hukum Syara', and includes the property so dedicated;

"Wakaf kahas" means a dedication in perpetuity of the capital of property for religious or charitable purposes recognized by Hukum Syara', the income of which is to be paid to a person or persons or for the purposes prescribed in the wakaf, and includes the property so dedicated;

"zakat" means a levy on property made payable by a Muslim according to Hukum Syara'.
