Process To Compel Appearance (Civil Cases)



Section 94. Evidence.

(1) The Court shall observe all provisions of Hukum Syara' relating to the witnesses or evidence required to prove any fact and their weight, number, status, or quality.

(2) Except as provided in subsection (1), the Court shall have regard to the law of evidence for the time being in force in the State and shall be guided by the principles stated therein, but shall not be obliged to apply them strictly.

(3) The Court is empowered to administer affirmations.

(4) Evidence shall ordinarily be given on affirmation in a form binding on persons professing the Religion of Islam.

(5) An affirmation shall read: "I ....................................................................................................................... (state name) solemnly affirm that my evidence shall be the truth, the whole truth, and nothing but the truth" or words to that effect.

(6) A witness shall be bound to speak the truth and shall affirm as provided in subsection (5) after having declared himself a witness by stating: "I .......................................................................................... (state name) do hereby stand witness in the matter of .......................................................... against .......................................................................... " or words to that effect.
