PART VII - HADHANAH
Section 70. Qualifications necessary for a hadhinah.
A female person shall be entitled to hadhanah if she-
(a) is a muslim;
(b) is mentally fit;
(c) is of an age capable of managing and showing love and affection that is required by the child;
(d) is of good conduct in the eyes of Islamic jurisprudence; and
(e) resides at the place where the child is unlikely to be exposed to bad influence morally or physically
