PART VII - SERVICE



Section 48. Substituted service.

(1) Where the Court is satisfied that a party who has given no address for service was at the date of the summons or other document to be served, resident within the State or Federation, and there is reason to believe that hr is keeping out of the way for the purpose of avoiding service, or that for any sufficient reason the summons or other document cannot be served in the ordinary way, the Court may order the summons or other document to be served by affixing a copy there of in same conspicuous place in the Court House and also upon same conspicuous part of the building in which the party to be served is known to have last resided, or in any other manner as the Court thinks fit.

(2) The Court may also, in any case falling within the terms of subsection (1) make an order for service by advertisement in such local a newspaper or newspapers as the Court may think fit.

(3) Substituted service be as effectual as personal service.

(4) In cases of substituted service, the Court, where it is necessary, shall fix the time for the apprearance of the party to be served.

(5) No order for substituted services shall be made in respect of-
