PART II - MARRIAGE
Section 10. Consent required.
(1) A marriage is not recognised and shall not be registered under the provisions of this Enactment except if both parties to the marriage have consented to the marriage and-
(a) the wali for the bride has consented to the marriage; or
(b) the Court having the jurisdiction in which the bride resides or domiciles has given generally or specifically, after due investigation in the presence of all the parties concerned, its consent to the marriage as wali raja:
Provided such consent may be given if the guardian is not available to act or if the wali has refused to give his consent.
(2) Anak dara may be married without her consent by her wali mujbir if-
(a) the wali mujbir or the groom is not in enmity with each other;
(b) the groom is of the same social status as her; an,
(c) the groom is in the position to pay maharmithil.
