PART IV - GENERAL PROCEDURE



Section 18. Peguam Syarie.


(1) The Chief Syariah Judge may permit any suitable person upon his application to be a Peguam Syarie.

(2) For the purpose of sub-section (1) of this section, the following person are deemed to be eligible and competent in matters pertaining to Hukum Syarak:
(3) Peguam Syarie shall not appear and plead in any court on behalf of any party in any proceedings unless a certificate in writing is issued by the Chief Syariah Judge and on payment of the prescribed fees. Such certificate shall be issued annually and signed by the Chief Syariah Judge.

(4) The Court may allow Government officers in their official capacity to appear and plead in the Court on behalf of any party in any proceedings.

(5) The Ruler, or any duly authorised person, may in writing appoint any suitable person to be a Peguam Syarie to defend or plead on behalf of a poor person in any proceeding, and in such event the Court fees normally payable in respect of the proceedings in question shall not be payable by such person, and shall be exempted.

(6) The Ruler may make rules providing for the control and supervision of any person permitted to represent any party in any proceedings before the Court.

(7) Notwithstanding anything contained in any other written law, no person, other than a Peguam Syarie or a person mentioned in section 18 (4), shall be entitled to appear in any Syariah Court on behalf of any party to any proceedings before it.
