PROVISIONS RELATING TO TESTAMENTARY DISPOSITION
Section 26. Bequest to heirs and non-heirs.
(1) Where a bequest is made to a person who is not an heir within the limit of one-third of the testator’s net estate after the payment of all his debts, the bequest shall be given affect to without obtaining the consent of the heirs.
(2) A bequest made to an heir in excess of one-third shall not be given effect to unless the heirs consent to it after the testator’s death.
(3) A bequest made by an indebted person shall take effect only to the extent of his remaining estate after the payment of all his debts.
