PART II - OFFENCES



Section 9. Khalwat.


(1) Any male person who, in any place, is found living with or cohabiting with or in retirement with or hiding or in close proximity with any female person who is not his muhram whether a Muslim or not in circumstances which arouse suspicion that they are committing maksiat shall be guilty of the offence of khalwat and shall be liable, on conviction, to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both.

(2) Any female person who, in any place, is found living with or cohabiting with or in retirement with or hiding or in close proximity with any male person who is not her muhram whether a Muslim or not in circumstances which may arouse suspicion that they are committing maksiat shall be guilty of the offence of khalwat and shall be liable, on conviction, to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both.

(3) Any male person who is found together with more than one woman whether Muslim or not who is not his wife or his muhram in a deserted place or in a room of any building or in a separate place in circumstances which may arouse suspicion that they are committing maksiat shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both.

(4) Any female person who is found together with more than one man whether Muslim or not who is not her husband or her muhram in a deserted place or in a room of any building or in it separate place in circumstances which may arouse suspicion that they are committing maksiat shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both.

(5) The Court may order any woman found guilty of an offence under this section to be committed to a welfare home for a period of three years.
