WAKAF (STATE OF MALACCA) ENACTMENT 2005
PART V - MAWQUF
Section 15. Conditions of mawquf.
(1) A mawquf shall be a property which is—
(a) owned by the waqif;
(b) unrestrained; and
(c) capable of yielding any usufruct or benefit.
(2) Subject to subsection (1), wakaf is valid even though at the time of its creation—
(a) the mawquf does not yield any usufruct or benefit; or
(b) the mawquf is still under tenancy.
(3) The usufruct or benefit of a mawquf shall be deposited into the Wakaf Fund.
