Section 14. Inheritence Certificates.


(1) If in the course of any proceedings relating to the administration or distribution of the estate of a deceased person who profess the religion of Islam any civil Court or authority which is under a duty to determine the persons entitled to share in the estate or the shares to which such persons are respectively entitled may request the Judge of the Syariah Subordinate Court, if the gross value of the estate does not exceed twenty five thousand ringgit, or the Judge of the Syariah High Court to certify upon the facts submitted to that Court its opinion as to the persons who are entitled to share in the estate and the proportion of shares to which they are entitled.

(2) The Judge of the Syariah High Court may on the application of a person claiming to be a beneficiary and on payment by him of the prescribed fee similarly certify its opinion upon facts submitted and may in any case before certifying its opinion require to hear the parties on a question of law, but shall not hear evidence or make findings on any question of facts. In any case of special difficulty the Judge of the Syariah Subordinate Court may refer the question to the Mahkamah Rayuan Syariah for its opinion and shall, if such opinion is given, certify in accordance therewith.
