PART IX - OFFENCES



Section 145. Lovemaking or khalwat.


(1) Any male Muslim found in close proximity with a female person or persons whether they are Muslims or not and they are not his wives or his mahram according to Hukum Syara' in a lonely place, or in a room of any building or in a secluded place, in circumstances that may give rise to suspicion that they are indulging in love-making or that they are intending to commit illicit sexual intercourse or that they have committed such act, shall be guilty of an offence and shall on conviction be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both. If he is found guilty for a second and subsequent offence he shall be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

(2) Any female Muslim found in the company of a male person or a number of male person whether or not they are Muslims and the male person is not her husband or her mahram, in circumstances similar to those in subsection (1) shall be guilty of an offence and shall on conviction be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both. And in the case of a second or any subsequent offence, he shall be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.

(3) Any male Muslim found living together with a female person whether or not he is a Muslim, as husband and wife, and not being married to each other or if married, the marriage is not recognized by Hukum Syara’, shall be guilty of an offence and shall on conviction be liable to the same punishment as provided for in subsection (1).

(4) Any female Muslim found living together with a male person whether or not he is a Muslim, as husband and wife and not being married to each other, or if married, the marriage is not recognised by Hukum Syara' shall be guilty of an offence and shall on conviction be liable to the' same punishment as provided for in subsection (2).

(5) Any Muslim who abets the commission of any offence under this section, shall be liable to the same punishment as provided for in subsection (1) if male and subsection (2) if female.
