PART VI - SERVICE



Section 46. Substituted service.


(1) Where the Court is satisfied that a party who has given no address for service was, at the date of the summons or other document to be served, resident within the State or Federation and there is reason to believe that he is keeping out of the way for the purpose of avoiding service, or that for any sufficient reason the summons or other document cannot be served in the ordinary way, the Court may order the summons or other document to be served by affixing a copy thereof in some conspicuous place in the Court House and also upon some conspicuous part of the building in which in the party to be served is known to have last resided, or in any other manner as the Court thinks fit.

(2) The Court may also, in any case falling within the terms of sub-section (1), make an order for service by advertisement in such local newspaper or newspapers as the Court may think fit.

(3) Substituted service shall be as effectual as personal service.

(4) In cases of substituted service the Court shall fix the time of appearance in Court for the party to be served where necessary.

(5) No order for substituted service shall be made in respect of-
