PART XIX - EXECUTION



Section 149. Entry on premises.


(1) The bailiff shall not break into any enclosed premises during the hours of darkness. Save as aforesaid, he may execute at any time on any day.

(2) The bailiff shall not make forcible entry into any house or inhabited building save by leave of the Court.

(3) On breaking open any door or container, the bailiff shall not use force to any greater extent than is reasonably necessary, and shall make reasonable provision for protection of anything exposed to risk thereby and shall, if reasonably possible, inform the owner or occupier of his intention to break open before doing so.
