PART XVI - AFFIDAVITS
Section 113. Cross- examination.
(1) Any party desiring to contest the truth of facts deposed to in an affidavit may serve on the party who filed the same notice of intention to cross-examine the deponent, and thereupon, if the deponent is not produce for cross-examination, the Court shall, except in special circumstances, reject or disregard the affidavit.
(2) The Court may of its own motion require the attendance of any deponent for examination on his affidavit and, in default of such attendance, may reject or disregard the affidavit.
