PART XXXIV - GENERAL PROVISIONS



Section 258. Furnishing security.


(1) Security shall be given by deposit of money or by bond. The amount shall be fixed by the Court or the Registrar. Expenses shall be borne by the person giving the security. The undertaking in writing of an advocate may be accepted in lieu of the other security.

(2) Where security is given by deposit of money, the money shall not be paid out without order of Court.

(3) Where security is given by bond two sureties shall be required unless the Court shall otherwise order, and the opposite party shall be given the opportunity to object to the sureties.
