PART III - CONSTITUTION OF SYARIAH COURTS APPOINTMENT OF OFFICERS AND THEIR JURISDICTION



Section 53. Power to investigate.


(1) Any Religious Inspector shall have the power to investigate into offences under section 49 on receipt of a reasonable complaint, offeces under section 50 on credible information or after he has effected arrest under section 51.

(2) Any Religious Inspector who conducts investigation under this section may examine orally any person believed to be acquainted with the circumstances relating to the case and shall reduce into writing any statement made by the person so examined.

(3) Any person so examined shall answer all question relating to such case:

Provided that such person may refuse to answer any question the answer to which would have tendency to expose him to a criminal charge.

(4) Any person making a statement under this section shall be legally bound to state the truth whether or not such statement is made wholly or partly in answer to question.

(5) Any Religious Inspector examining a person under subsection (2) shall first before proceeding to examine inform that person of the provisions of subsection (3) and (4).
