PART IV - MARRIAGE, DIVORCE AND RUJUK



Section 64. Application to marry.


(1) Whoever intends to marry shall complete the required forms and shall forward them to the Registrar to reach him not less than seven days before the date of the solemnisation of the marriage, save when the marriage shall require to be solemnised urgently on the grounds that the Registrar thinks reasonable and in such a case the condition as to time may be dispensed with.

(2) If a woman within the State intends to marry outside the area of her residence her marriage may be solemnised by the Registrar of that other area after he has received from the Registrar of the area in which she resides an intimation that he has no objection to the marriage.

(3) If a woman from another State intends to marry in the State, the Registrar for the area in which the marriage is to be solemnised shall first obtain a detailed information in respect of the woman from the Kadi or her place of residence through the Kadi Besar of the State. On receiving the said information and if there shall be no objection indicated therein for the marriage to be solemnised, the marriage may then take place.

(4) If a woman comes from an area of another Registrar in the State of from another State accompanied by her Wali with documents certified from the Kadi of her place or residence, the marriage may be solemnised by the Registrar of the area where she intends to marry if he is satisfied with the evidence available which will allow him to perform the ceremony.
