(1) His Royal Highness the Sultan may, on the advice of the Majlis, appoint a Chief Syarie Judge.
(2) A person is qualified for appointment under subsection (1) if-
(a) he is a citizen of Malaysia; and
(b) he-
(i) has, for a period of not less than ten years preceding his appointment, been a Judge of a Syariah High Court or a Kadi or a Registrar of the Syariah High Court or the Chief Registrar of the Syariah Appeal Court or a Syarie Prosecutor of the State of Kedah Darul Aman or sometimes one and sometimes another; or
(ii) is a person learned in Hukum Syarak.
(3) The person who, immediately before the commencement of this section, was holding the post of Chief Syarie Judge and was performing judicial functions shall, on the commencement of this section, continue to hold office as the Chief Syarie Judge as if he had been appointed under subsection (1).
(4) The appointment under this section shall be published in the Gazette.
