PART IV - MARRIAGE, DIVORCE AND RUJUK
Section 58. Bethrothal.
(1) If any person shall, either orally or in writing, and either personal1y or through an intermediary, have entered into a contract of betrothal in accordance with Hukum Syara' , and shall subsequently refuse without lawful cause to marry the other party to such contract, such other party being willing to perform the same, the party In default shall be liable to pay to the other party a certain sum of money as may be agreed upon unless otherwise as may be determined by local custom.
(2) If a contract of betrothal shall be followed by a marriage (known as Nikah Gantung) and in case any party shall subsequently refuse to consumate the marriage in similar circumstances as in subsection (1), the provisions in the said subsection shall apply to the
party refusing to do so.
