PART X - PROCEDURE IN CRIMINAL PROCEEDINGS



Section 211. Procedure at hearing.


(1) When the appeal comes on for hearing, the appellant, if present, shall be first hear and then the respondent shall be heard it and the appellant shall be entitled to reply to the respondent's case. After that the Court of Appeal may make its decision.

(2) If, on the day of the hearing of the appeal the appellant does not appear, the Court of Appeal may dismiss the appeal or make whatever order it thinks just.

(3) If, on the day of the hearing of the appeal, the respondent does not appear and the Court of Appeal is not satisfied that the notice of Appeal has been properly served on the respondent the Court shall postpone the hearing of the case.

(4) But if the Notice of Appeal has been properly served on the respondent and he does not appear or the Notice cannot be served on him, the Court of Appeal shall hear the appeal.
