PART X - PROCEDURE IN CRIMINAL PROCEEDINGS



Section 194. By whom and how summons is served.


(1) A summons issued under section 193 shall be served by a process server of the Kadi's Court or by a member of the police force.

(2) The summons shall if practicable be served personally on the person summoned by showing him the original summons and by delivering to him a copy thereof.

(3) The serving officer shall require the person summoned to sign on the back of the original summons as evidence of the receipt of the copy thereof and then return the original summons to the Court issuing it.

(4) If the signature of the person summoned cannot be obtained, the serving officer after having left a copy of the summons with the person summoned shall note on the back of the original summons the manner and time of service and then return it to the Court issuing it.

(5) If the person to be summoned cannot be found, the serving officer may leave a copy thereof for him with some adult member of his family or with his servant residing with him. The serving officer shall note his action on the back of the original summons and than return it to the Court issuing it.

(6) If the person to be summoned cannot be found and no adult member of his family or his servant is found at the house where he is believed to be ordinarily residing, a copy of the summons may, with leave of the Court, be affixed at any conspicuous part of the house.
