Section 12. Appointment of Syariah High Court Judges
(1) His Royal Highness the Sultan may, on the advice of the Majlis, appoint the Judges of the Syariah High Court.
(2) Before giving its advice on the appointment of a Judge of the Syariah High Court the Majlis shall refer the matter to the Chief Syarie Judge.
(3) A person is qualified for appointment under subsection (1) if-
(a) he is a citizen of Malaysia; and
(b) he-
(i) has, for a period of not less than ten years before his appointment, been a Judge of a Syariah Subordinate Court or a Kadi or a Registrar of the Syariah High Court or the Chief Registrar of the Syariah Appeal Court or a Syarie Prosecutor of the State of Kedah Darul Aman or sometimes one and sometime another; or
(ii) is a person learned in Hukum Syarak.
(4) A person who, immediately before the commencement of this section, was holding the post of Syariah High Court Judge and was performing judicial functions shall, on the commencement of this section, continue to hold office as Judges of Syariah High Court Judge as if he had been appointed under subsection (1).
(5) All appointments under subsection (1) shall be published in the Gazette.
