PART IV - MARRIAGE, DIVORCE AND RUJUK
Section 73. Tebus Talak or divorce at wife's request.
(1) A wife may apply to a Kadi for a divorce in accordance with Hukum Syara' .
(2) The Kadi on receipt of an application for a divorce under subsection (1) shall summon the husband to appear before him and enquire whether he consents to the divorce. If the husband consents, the Kadi shall on payment of the prescribed fees cause him to
pronounce the divorce and in the capacity of Registrar the Kadi shall then registrar the divorce and issue a certificate thereof to the parties.
(3) If the husband does not agree to the divorce by consent under subsection (2) but the parties agree to a divorce by Tebus Talak, the Kadi after the amount of the payment for Tebus Talak is agreed upon by the parties and upon payment of the prescribed fees may cause the husband to pronounce a divorce by Tebus Talak and the Kadi in the capacity of Registrar shall then register the divorce and issue a certificate thereof in the manner aforesaid.
(4) If the husband does not agree to a divorce by Tebus Talak the Kadi may appoint Hakam in accordance with section 79.
