PART X - PROCEDURE IN CRIMINAL PROCEEDINGS

Section 192. Application for summon and warrant of Arrest by Religious Prosecutor.

Having studied the investigation papers in respect of a case and the Religious Prosecutor is satisfied that a particular offence under this Enactment is disclosed he shall take the following action-

(a) If proceedings in respect of the offence shall be required to commence by way of Summons, the Religious Prosecutor shall apply for a Summons to the Kadi of the area in which the offence took place by enclosing with his application a complete charge sheet together with the facts of the case in brief.

(b) If proceedings in respect of the offence may be commenced by way of a warrant of arrest, the Religious Prosecutor shall apply for a warrant to the Kadi of the area in which the offence took place by enclosing with his application a complete charge sheet together with the fact of the case in brief.
