PART II - OFFENCES



Section 9. Khalwat.


(1) Any male person who, in any place, found living with or cohabiting with or in retirement with or hiding with any female person who is not his muhram other than his spouse that would arouse suspicion that they commit maksiat shall be guilty of an offence of khalwat and shall be liable, on conviction, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.

(2) Any female person who, in any place, found living with or cohabiting with or in retirement with or hiding with any male person who is not her muhram other than her spouse that would arouse suspicion that they commit maksiat shall be guilty of an offence of khalwat and shall be liable, on conviction, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.

(3) Any male person who is found together with more than one woman who is not his spouse or his muhram in a deserted place or in a room of any building or in a separate place in circumstances which may arise suspicion that they commit maksiat shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

(4) Any female person who is found together with more than one man who is not her spouse or her muhram in a deserted place or in a room of any building or in a separate place in circumstances which may arise suspicion that they commit maksiat shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

(5) The Court may order any woman found guilty of an offence under this section be committed to a welfare home for a period of three years.
