Section 85. Presumption of death.
(1) If the husband is believed to have died or has not been heared of in such circumstances that he ought, for the purpose of enabling his wife to remarry, to be presumed in accordance with Hukum Syara' to be dead, a Kadi may, on the application of the wife, issue a certificate of presumption of death of her husband, based on the presumption under Hukum Syara' notwithstanding the provisions of any other written law to the contrary and with the certificate the wife shall be at liberty to remarry and such certificate shall be deemed to be a certificate of the death of the husband for the purposes of section 60 (2) (a).
(2) A certificate issued under subsection (1) shall be registered as if a divorce has taken place.
