PART V - PUNISHMENT
Rule 39. Fine or forfeiture of emoluments
(1) For the purpose of these rules, punishment of fine or forfeiture of emoluments shall be made in accordance with the following provisions:
(a) any fine imposed on anyone occasion shall not exceed an amount equivalent to seven days' emoluments of the officer or servant concerned; and if an officer or servant is fined on more than one occasion in any calendar month, the aggregate of the fines imposed on him in that month shall not exceed an amount equivalent to forty-five percent of his monthly emoluments;
(b) punishment of forfeiture of emoluments is not subject to paragraph (a) above relating to the maximum amount of fine on anyone particular occasion or in anyone particular month; where the punishment is connected to the offence of absence without leave or without prior permission or without reasonable cause, the amount of emoluments to be forfeited shall, unless otherwise decided by the Disciplinary Committee, be calculated by having regard to the actual period the officer or servant is absent:
Provided that this punishment shall not be imposed on an officer or servant who is absent without leave or without prior permission or without reasonable cause where such officer or servant has been forfeited of his emoluments in respect of such absence under any provision relating to leave; and
(c) all fines or forfeitures of emoluments shall be deducted from the monthly emoluments of the officer or servant concerned and shall be paid or transferred to the credit of the General Administration fund of the Majlis.
(2) An annual statement shall be made to the Majlis showing the balance to the credit of the General Administration Fund of the Majlis on the 31st December of each year.
(3) The Majlis may direct the manner in which the monies paid into the Fund from fines or forfeiture of emoluments are to be disbursed:
Provided that any disbursement made shall be in a manner beneficial to the officers or servants of the Majlis in general.
