Procedure In Cases Where Officer Or Servant Is Charged In The Criminal Court Or Imposed With An Order Of Detention, Banishment, Etc.

Rule 37. Consideration of Disciplinary Committee in cases of conviction and detention.

(1) Where, after considering the report and the recommendation of the Head of Department forwarded in accordance with rule 33 or 36, the Disciplinary Committee is of the opinion-

(a) that the officer or servant should be dismissed or reduced in rank, the Disciplinary Committee shall forthwith impose the appropriate punishment;

(b) that the officer or servant should not be dismissed or reduced in rank but should be imposed with a lesser punishment, the Disciplinary Committee shall impose the officer or servant such lesser punishment as it deems fit and proper; or

(2) Where an officer or servant is punished with a punishment other than dismissal or where no punishment is imposed, the Disciplinary Committee shall direct the officer or servant to resume his duties and-

(a) in the case where no punishment is imposed, shall direct that the officer or servant be paid any part of the emoluments which had not been paid to him during the period of his interdiction or suspension;

(b) in the case where punishment is imposed, may, in its discretion, direct that the officer or servant to be paid any part of the emoluments which had not been paid to him during the period of his interdiction or suspension.
