PART VI - INTERDICTION AND SUSPENSION




Rule 48. Leaving the country whilst under interdiction or suspension.

(1) An officer or servant who is interdicted or suspended shall not leave Malaysia without the prior written permission of the Disciplinary Committee; and if the said officer or servant is serving outside Malaysia, he may be recalled to Malaysia forthwith and, pending a decision as to whether he should be reinstated or dismissed, he shall not leave Malaysia without the prior written permission of the Disciplinary Committee.

(2) Notwithstanding the provisions of subrules 44 (3) and 45 (3), the Disciplinary Committee shall take all necessary steps to stop the payment of any emoluments to an officer or servant who is interdicted and who has left Malaysia without the prior written permission of the Disciplinary Committee.

(3) Notwithstanding the provisions of subrule (1), where criminal proceedings have been instituted against an officer or servant in a foreign country, the officer or servant shall be interdicted in accordance with rule 44 and shall be placed in the custody of the Malaysian Mission in that country and he shall not be allowed to leave that country.
