Procedure In Cases Where Officer Or Servant Is Charged In The Criminal Court Or Imposed With An Order Of Detention, Banishment, Etc.




Rule 35. Consequences of acquittal.

(1) An officer or servant who is acquitted by a court on a criminal charge shall not be subject to disciplinary action on the same charge.

(2) Nothing in subrule (1) shall be construed so as to prevent disciplinary action from being taken against the officer or servant on any other ground arising out of his conduct in relation to the criminal charge, whether or not connected to the performance of his duties:

Provided that the grounds for the disciplinary action shall not raise substantially the same issues as those on which the officer or servant was acquitted.
