THE COUNCIL OF RELIGION OF ISLAM AND MALAY CUSTOM, KELANTAN (CONDUCT AND DISCIPLINE) RULES 1999




Rule 10. Ownership of property.

(1) Subject to subrule (2), an officer or servant shall, in the case of a first appointment, within three months after his appointment as an officer or servant of the Majlis and, in any other case, within three months after the publication of these rules in the Gazette, declare in writing to the Disciplinary Committee through the Head of Department all property belonging to him, his spouse or child or held by any person on his behalf or on behalf of his spouse or child. An officer or servant who does not own any property shall accordingly declare in writing to that effect.

(2) A serving officer or servant need not declare under subrule (1) any property already declared by him before the publication of these rules.

(3) Where, after making a declaration under subrule (1), an officer or servant or his spouse or child acquires any property, either directly or indirectly, or disposes of any property acquired by him or them, he shall immediately declare such acquisition or disposal of property to the Disciplinary Committee through the Head of Department.

(4) Where an officer or servant or his spouse or child proposes to acquire any property, and the proposed acquisition is inconsistent with the code of conduct laid down in rule 4, the acquisition shall not be made without the officer or servant having first obtained the permission in writing of the Disciplinary Committee.

(5) In deciding whether or not to grant permission subrule (4), the Disciplinary Committee shall have regard following:


(6) If the Disciplinary Committee is satisfied with the declaration of property made by the officer or servant it shall direct the Head of Department to record in the officer's or servant's Record of Service that the declaration had been made.

(7) In this rule-

"child" includes an adopted child but does not include a child who is not dependent on the officer or servant;

"property" includes property of any description, whether movable or immovable, as may be prescribed by the Board from time to time.
