PART IV - DISCIPLINARY PROCEDURE General Procedure
Rule 25. Conditions for dismissal or reduction in rank.
(1) Subject to the provisions of subrule (2), no, officer or servant shall be dismissed or reduced in rank in any disciplinary proceedings under this Part unless he has been informed in writing' of the grounds on which it is proposed to take action against him and has been afforded a reasonable opportunity of being heard.
(2) Subrule (I) shall not apply in the following cases:
(a) where an officer or servant is dismissed or reduced in rank on the ground of conduct in respect of which a criminal charge has been proved against him; or
(b) where the Disciplinary Committee is satisfied that for some reason, to be recorded by it in writing, it is not reasonably practicable to carry out the requirements of this rule; or .
(c) where the His Royal Highness The Sultan is satisfied that in the interests of the security of the Federation or any part thereof it is not expedient to carry out the requirements of this rule; or
(d) where there has been made against the officer or servant any order of detention, supervision, restricted residence, banishment or deportation, or where there has been imposed on such officer or servant any form of restriction or supervision by bond or otherwise, under any law relating to the security of the Federation or any part thereof, prevention of crime, preventive detention, restricted residence, banishment, immigration, or protection of women and girls.
