THE COUNCIL OF RELIGION OF ISLAM AND MALAY CUSTOM, KELANTAN (CONDUCT AND DISCIPLINE) RULES 1999




Rule 3. Interpretation.

In these rules, unless the context otherwise requires-

"convicted" or "conviction" includes a finding or an order involving a finding of guilt by a criminal court in Malaysia or outside Malaysia, or by any Syariah Court, or by a competent body conferred with the power to conduct summary investigation under any written law, that the person charged or accused has committed an offence;

"court" includes a Syariah Court established under the Administration of the Syariah Court Enactment 1982;

"Disciplinary Committee" means the Disciplinary Committee established under Section 17C of the Enactment;

"emolument" means all remuneration in money due to an officer or servant and includes basic pay, fixed rewards, incentive payments and other monthly allowances;

"Enactment" means the Council of Religion of Islam and Malay Custom, Kelantan, Enactment 1994;

"Head of Department" means the President, Vice-President, Head of Division or Unit or any officer in charge of any Division or Unit of the Majlis, or any officer who is authorized in writing by the President to act on his behalf;

"Majlis" shall have the same meaning as that assigned to it under the Enactment;

"officer or servant" means a person appointed under Section 17 of the Enactment including persons in permanent, temporary or contractual employment but does not include-

"President" shall have the same meaning as that assigned to it under the Enactment;

"salary" means the basic pay of an officer or servant.
