Rule 8. Present. etc.
(1) Subject to. the provisions of this rule, an officer of servant shall not receive or give, nor shall he allow his spouse or any other person to receive or give on his behalf, directly or indirectly, any present (whether in a tangible form or otherwise) from or to any association, body, person or group of person if-
(a) the receipt of giving of such present is in any way connected with the performance of the officer's or servant's duties; and
(b) the form, amount or value of the present is not commensurate with the purpose of such present being given.
(2) The Head of Department may permit an officer or servant to receive a letter of commendation from any association, body, person or group of persons on the occasion of the officer's or servant's retirement or transfer provided that such letter of commendation is not enclosed in a receptable of value.
(3) The Head of Department may permit the collection of spontaneous subscriptions by officers or servants under him for the purpose of making a presentation to an officer or servant in his department on the occasion of the said officer's or servant's retirement, transfer or marriage or the marriage of the said officer's or servant's child or on any other appropriate occasion.
(4) Where-
(a) an officer or servant is in doubt as to whether the form, amount or value of a present received by him is commensurate with the purpose of such present being given; or
(b) circumstances make it difficult for an officer or servant to refuse a present or token of value, the receipt of which is prohibited by this rule,
such present may formally be accepted but the officer or servant shall, as soon as practicable, submit a report in writing to the Head of Department containing a full description and the estimated value of the present and the circumstances under which it was received.
(5) Upon receipt of the report made under subrule (4), the Head of Department shall decide whether-
(a) to permit the officer or servant to retain the present; or
(b) to direct that the present to returned to the giver through the Head of Department.
