Rule 33. Suspension or removal from office.
(1) If any member of a Jawatankuasa Qaryah or Pegawai Masjid or the committee for a bureau of a qaryah masjid-
(a) has been absent from three successive meetings of the Jawatankuasa Qaryah or committee for a bureau without giving any satisfactory excuse to the Chairman;
(b) is found guilty at any time of an offence involving fraud, treachery or bad conduct or is found guilty of an offence punishable by imprisonment (either imprisonment only or in addition to a fine or as a substitute for fine) for a term of two years or more;
(c) prevents or refuses to allow an inspection to be carried out under paragraph 30(a);
(d) fails to comply with a requirement under paragraph 30(b);
(e) neglects in carrying out his duties;
(f) fails to comply with any direction issued by MAINPP or JAIPP under these Rules; or
(g) conducts himself in a manner which brings the religion of Islam into disrepute,
MAINPP may suspend or remove from office the Pegawai Masjid or member of the Jawatankuasa Qaryah or direct the head of the bureau to remove the member of the committee for the bureau from office.
(2) Notwithstanding subrule (1), no person may be suspended or be removed from office under that subrule unless he has been given an opportunity to be heard.
(3) Subrule 7(3) shall apply in respect of the office vacated by reason of a removal from office under this rule, except that for a member of the committee for a bureau the appointment shall be made by the head of the bureau.
